Store regulations

§1

General provisions

  1. These Regulations define the conditions for concluding contracts for the sale of goods in the online store operated in the almidecor.com domain and the procedure for submitting complaints regarding goods purchased there.

  2. The legal basis for these Regulations is in particular:

    1. Act of 18 July 2002 on the provision of services by electronic means;

    2. Act of 30 May 2014 on consumer rights;

    3. Act of 23 April 1964, Civil Code;

    4. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

  3. The terms used in these Regulations mean:

    1. Shop – an online shop located in the almidecor.com domain , within which distance sales contracts are concluded;

    2. AlmiDecor or Seller - Fargotex Sp. z o. o. with its registered office at Al. Legionów 114C, 18-400 Łomża, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000183232, NIP (Tax Identification Number): 7181721036, REGON (National Business Registry Number): 450692080, being the owner of the Store;

    3. Customer - an entity (including a Consumer) making purchases in the Store;

    4. Consumer – a natural person making purchases in the Store for purposes not directly related to his or her business or professional activity;

    5. Goods or Goods – movable items that can be purchased by the Customer in the Store;

    6. Order – the procedure leading to the conclusion of a Sales Agreement using the order form available on the Store’s website;

    7. Agreement – ​​a contract for the sale of Goods concluded between the Customer and AlmiDecor,

    8. Shopping Cart – an electronic form through which the Customer places an Order;

    9. Registration – creation by the Customer of an individual account in the Store, facilitating the placement of Orders;

    10. Data – Customer data, including personal data processed for the purpose of fulfilling the Order;

    11. Account – individual Customer account created after Registration,

    12. Price – the unit price of the Goods included in the description of the Goods, expressed in Polish zlotys and including VAT, excluding delivery costs;

    13. Delivery costs – costs of delivering the Goods covered by the Customer;

    14. Payment – ​​payment for the Goods purchased by the Customer in the Store, including the Price and Delivery Costs, in the manner chosen by the Customer when placing the Order;

    15. Regulations – these regulations for using the Store,

  4. Information about the Goods in the Store, including descriptions and Prices, constitutes an invitation to conclude a Contract, within the meaning of Article 71 of the Civil Code, on the terms specified in the Regulations.

  5. The Store is accessed via an IT system. This requires a device with internet access and a web browser.

  6. Before registering or placing an Order, the Customer is obliged to read the content of these Regulations and the document specifying the principles of processing Customers' personal data - Privacy Policy and accept them.

  7. The content of the Store's website is the property of the seller and is legally protected.

§2

Placing Orders

  1. You, as a Customer of the Store, can place an Order in the Store using your Customer Account or, without the need to register, by completing the Order form (so-called Basket).

  2. Orders can be placed 24 hours a day, but are processed on business days (Monday to Friday).

  3. The goods in the Store are new and free from legal defects. If the goods are defective, you have warranty rights regulated by the Civil Code, as described below.

  4. We may conduct periodic or one-time discounts and promotional campaigns for selected Clients or groups of Clients. These campaigns will be conducted according to separate rules and, when required, based on appropriate regulations.

  5. To place an Order, you select the Goods and specify the quantity, payment method, and delivery method. The selected Goods will be added to your Shopping Cart, where you can then begin the Ordering process.

  6. In order to properly complete your Order and confirm all elements of the concluded Contract, we need the following Data:

    • Client's name and surname,

    • delivery address,

    • phone number,

    • email address.

  7. Providing the above data is voluntary, but necessary for the fulfillment of your order. If we have any doubts as to the veracity or accuracy of the data, we will attempt to contact you to verify it.

  8. The condition for placing an Order is acceptance of the Regulations and the Privacy Policy by checking the appropriate box.

  9. After completing the Order placement process and selecting all delivery parameters, in order to send the Order, you should click the "Order and pay" icon, which is tantamount to accepting the obligation to pay the Price and Delivery Costs for the Goods you ordered.

  10. After submitting your Order to us as described in Section 9 above, you will receive an email confirming the conclusion of the Agreement and acceptance of your Order for processing. Please contact us if you do not receive an email confirming your order.

  11. Upon receipt of the e-mail referred to in paragraph 10 above, an Agreement is concluded under which AlmiDecor is obliged to deliver the Goods selected by you and you are obliged to pay the Price and Delivery Costs.

  12. Payments can be made by credit card, online transfer, using fast online transfer applications, or upon receipt of the Goods (cash on delivery). If cash on delivery is not selected, we will begin processing your Order upon receipt of your payment. In such a case, please make the payment within 24 hours of receiving our confirmation of the Agreement, as we will reserve the Goods selected in your Order during this time. More information on payment methods can be found in § 4 below.

  13. AlmiDecor may change the range of Products in the Store, their Prices, and Shipping Charges. This will not amend the Agreement concluded before the above changes.

  14. If the ordered Goods are unavailable in the Store and we are unable to deliver them within the specified Order processing times, we will immediately refund you the Price and Delivery Costs (if any).

  15. AlmiDecor also allows you to place an order by email to sklep@almidecor.com or by phone through a consultant at 22 49 80 10. The provisions of these regulations apply to such orders.

§3

Account

  1. The Store offers the ability to create an individual Customer Account through Registration. When placing orders using your Customer Account, you do not need to provide data each time, and you can also use other Store functionalities, as indicated in Section 7 below.

  2. In order to create a Customer Account, you must register using the electronic registration form provided on the Store's website.

  3. The registration form contains fields that are voluntary, but necessary to create an Account and place Orders through it. You must provide the following information in particular:

    • name and surname,

    • email address,

    • phone number,

    • password.

  4. Please provide correct and true data so that we can process your orders correctly and efficiently.

  5. Access to the Account is secured by a password chosen by you, which can be changed using the appropriate functionality available on the Account pages.

  6. The password should not be shared with third parties. This does not apply to Customers who are entrepreneurs who share the password within the organizational structure of their company.

  7. Having an individual Account will enable you, in particular:

    • placing Orders without the need to provide Data each time for Order fulfillment (in the event of a change of delivery address, the Customer may provide several addresses),

    • viewing the customer's purchase history,

    • monitoring the status of placed Orders,

  8. After submitting the completed registration form, you will receive an email confirmation confirming the creation of your Account, which you can then use. An activation email will be sent to the email address you provided. Clicking the link in this email constitutes acceptance of the Terms and Conditions and the Privacy Policy and leads to the conclusion of an agreement for the provision of electronic services for an indefinite period.

  9. Data can be edited and corrected by editing the "My Account" tab. You can also supplement your Account Data, in particular with the following information:

    • address,

    • phone number,

    • date of birth,

    • in the case of Customers who are entrepreneurs: company name, company registered office address, Tax Identification Number.

  10. You may terminate the agreement for the provision of electronic services at any time and without giving any reason with immediate effect by deleting your Account. To do this, log in to your Account and click the "delete account" option.

  11. The Seller may terminate the contract for the provision of electronic services with immediate effect and delete the Account if you use the Store in a manner contrary to generally applicable law, the provisions of the Regulations, as well as good manners, or if you provide illegal content.

  12. Deleting the Account does not affect the performance of Agreements concluded before deleting the Account.

§4

Payments

  1. Payments can be made before the Order is processed (prepayment) or upon receipt (cash on delivery), depending on the payment method you choose,

  2. In the scope of payment in advance (before the execution of the Order), the Seller accepts the following payment methods:

    1. payment by payment card (debit) or credit card via an external payment operator (Tpay) – payment for the order using Visa or MasterCard;

    2. payment by electronic transfer – payment for the order via direct transfer from an account in one of the selected banks: Alior Bank SA, Bank Pekao SA, PKO Bank Polski, Inteligo, mBank, ING Bank Śląski SA, Bank Millennium SA, Bank Zachodni WBK SA, Eurobank, Citibank Handlowy SA, Credit Agricole Polska SA, Getin Bank SA, T-Mobile Usługi Bankowe, Bank Pocztowy SA, Bank Ochrony Środowiska SA, Idea Bank, Cooperative Banks, Bank Gospodarki Żywnościowej SA, Neo Bank, Raiffeisen Bank Polska SA, Deutsche Bank PBC SA, Smart Bank, Plus Bank SA, Toyota Bank, Volkswagen Bank;

    3. payment from PayPal account - payment for the order via transfer from a PayPal account or a card configured with it;

    4. transfer to the AlmiDecor company account – payment for the order to the following company account:

      Please enter your order number as the transfer title.
      If payment is not made within 14 days, the order will be automatically canceled.

  3. In the case of cash on delivery (Standard shipping within the EU only) – payment for the order is made upon delivery by the courier.

  4. If you choose to pay using the method described in paragraph 2 points a) and b) above, the Customer will be automatically redirected to an external electronic payment service (Tpay or PayPal) and will follow the instructions provided there. Making a payment using an external operator requires registration with the selected payment service.

  5. The date of payment is the date on which the amount is credited to AlmiDecor’s bank account or the date of receipt of confirmation of accepted payment from an external payment operator.

  6. Cash on delivery payments (upon receipt of the Order from the courier company) may be made by paying cash to the courier for Orders fulfilled by the courier company.

  7. AlmiDecor automatically issues a VAT invoice for customers who provide their Tax Identification Number when placing an order.

  8. AlmiDecor accepts the payment methods listed above. Information about accepted payment methods is also available on the Store's home page.

  9. AlmiDecor does not charge any additional fees for your chosen payment method beyond the costs incurred by AlmiDecor in this respect.



All payment methods meet the highest standards for the security of your data.

§5

Delivery

  1. Goods purchased in the almidecor.com store are delivered to the address indicated in the Order.

  2. Delivery of the ordered Goods is carried out within the European Union.

  3. At AlmiDecor we offer the following delivery options:

    1. Standard Delivery:

      • Standard Delivery includes shipping of goods to the address indicated by the Customer without the option of additional unpacking and assembly.

      • Standard delivery within the EU is priced individually each time.

      • Standard delivery is available throughout Poland and European Union countries.

      • Standard delivery (courier shipment) within Poland is carried out in the case of payment both in advance (before the Order is processed) and cash on delivery (upon receipt of the Order),

      • Delivery of bulky goods (volume shipment) within Poland is only possible upon payment in advance (before the Order is processed), payment upon receipt of the Order is not possible,

      • Delivery of Bularyt (courier shipment or bulky shipment) in other European Union countries is carried out only in the case of payment in advance (before the execution of the Order); payment upon receipt of the Order is not possible.

  4. Ordered goods are shipped within the time specified during the ordering process and on the store's website in the order basket. Goods are shipped after payment has been credited to our account or after we receive payment confirmation from our billing partner.

  5. In the case of Goods that we currently have in stock, the delivery time should not be longer than 4 business days from the date of shipment.

  6. You will receive details regarding the delivery of the Goods during the Order placement process in the Basket, next to the selected Goods, and also in the "Order Summary" tab.

  7. Upon receipt of your shipment, after signing the bill of lading, please open the package and carefully inspect the ordered goods for any mechanical damage. If you notice any mechanical damage that occurred during transport, please refuse acceptance of the package and complete a damage report with the courier. Please inform the store staff of the problem by email (sklep@almidecor.com) or by phone (22 490 80 10).

  8. IMPORTANT! If full payment for the Order is not made within 14 days of placing the Order, the Seller has the right to withdraw from the Agreement. Notice of withdrawal will be preceded by an email reminder to pay the Order fee, failing which the Order will be cancelled.

§6

Withdrawal from the Agreement

  1. If you conclude the Agreement as a Consumer, you have the right to withdraw from the concluded Agreement without giving any reason, under the terms indicated below.

  2. The deadline for withdrawal from the Contract expires after 14 days from the day on which you came into possession of the Goods or on which a third party other than the carrier and indicated by you came into possession of the Goods.

  3. To exercise the right of withdrawal, you must inform us of your decision to withdraw from the Contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail) to the following address: AL. Marszałka Józefa Piłsudskiego 70, 18-400 Łomża .

  4. You may use the model withdrawal form that will be delivered to you along with the Goods, but this is not mandatory. You may also complete and scan the withdrawal form or any other clear statement by email to the following address: sklep@almidecor.com . If you use this option, we will immediately send you a confirmation of receipt of your withdrawal on a durable medium (e.g., email).

  5. In order to meet the withdrawal deadline, it is sufficient for you to send information concerning the exercise of your right to withdraw from the Contract before the expiry of the withdrawal deadline.

  6. The Goods in respect of which you are withdrawing from the Contract must be returned to the following postal address: AL. Marszałka Józefa Piłsudskiego 70, 18-400 Łomża, immediately, and in any event no later than 14 days from the day on which you informed us of your withdrawal from this Contract. The deadline is met if you send back the Goods before the expiry of the 14-day period.

  7. In the event of withdrawal from the Agreement, AlmiDecor will refund the purchase price and the delivery costs selected when placing the Order (Standard or Premium). These costs will be refunded within 14 days of the date on which we are informed of your decision to exercise your right to withdraw from the Agreement.

  8. AlmiDecor is not responsible for shipping the goods from the Customer to the Seller's office. The costs of returning the goods are borne by the Buyer – returns sent at the Seller's expense will not be accepted.

  9. Any refunds related to the Customer's withdrawal from the Agreement will be made using the same payment method used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of this refund. IN THE CASE OF CASH ON DELIVERY PAYMENT, THE REFUND WILL BE MADE TO THE ACCOUNT NUMBER PROVIDED BY THE CUSTOMER. We may withhold reimbursement until we receive the Goods or until you provide us with proof of having sent them back, whichever comes first.

  10. Pursuant to Article 38, point 3 of the Consumer Rights Act, you do not have the right to withdraw from the Agreement if the Goods were manufactured in accordance with your specifications or were adapted to your individual needs (e.g. furniture modifications in accordance with your wishes),

  11. The customer is liable for any reduction in the value of the goods resulting from the use of the goods in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

§7

Complaints: compliance of the goods with the contract / defects

We are obligated to deliver goods free from defects. If the goods do not conform to the contract, the Consumer has the rights specified in Chapter 5a of the Consumer Rights Act. Under the terms specified therein, the Consumer may request the repair or replacement of the non-conforming goods, submit a declaration of a price reduction, or withdraw from the contract. We are liable for any lack of conformity of the goods with the contract discovered within two years of delivery, unless we have specified a longer expiration date for the goods in question, in which case the longer period applies. In the event of non-conformity of the goods with the contract, the above provisions regarding the Consumer also apply to individuals entering into a contract directly related to their business activity, if the content of the contract indicates that the contract is not of a professional nature for that individual, in particular arising from the subject of their business activity, as disclosed under the provisions of the Central Registration and Information on Business.

IMPORTANT! When receiving your order, please carefully inspect the goods for any mechanical damage that may have occurred during transport. Upon receipt of the package, after signing the bill of lading, please open the package and carefully inspect the ordered goods for damage. If you notice any mechanical damage that occurred during transport, you should refuse acceptance of the package and complete a damage report with the courier. Please inform the Customer Service Department (tel. 22 490 80 10) of the problem.

§8

Special provisions related to the provision of services by AlmiDecor electronically

  1. In the scope of services provided electronically by AlmiDecor, the Regulations constitute the regulations for the provision of services electronically within the meaning of the relevant provisions of law.

  2. The Regulations may be downloaded without any restrictions from the website almidecor.com as a PDF file, saved on memory media and printed in any number of copies.

  3. The types and scope of services provided electronically by the Store are as follows:

    1. Concluding online sales contracts – in the scope of Goods sold in the Store,

    2. Ability to track order status,

    3. Possibility to add opinions and comments,

    4. Sending a newsletter – if the Customer consents to receiving commercial information.

  4. The conditions for providing services by electronic means, in particular the technical requirements necessary for cooperation with the IT system used by the Store, are as follows:

    1. connection to the Internet (with a minimum bandwidth of not less than 1 Mbits/512 kbits, permanent, public address),

    2. a web browser that allows you to display hypertext documents (HTML) on your computer screen, such as Firefox, Internet Explorer or similar,

    3. having an email account.

  5. It is prohibited for Store Customers to provide illegal content.

  6. The complaint procedure regarding services provided electronically is as follows:

    1. In the scope of performance of Sales Agreements, the conditions for submitting complaints are specified in § 7 of the Regulations,

    2. To the extent not related to the performance of sales contracts, service recipients have the right to submit complaints regarding services provided electronically by AlmiDecor in the manner described below,

      • Complaints may be sent by e-mail to: sklep@almidecor.com or submitted in writing to : Fargotex Sp. z o. o., Al. Legionów 114C, 18-400 Łomża ,

      • The complaint should include the name of the service recipient and an indication of the circumstances justifying its submission,

      • We will make every effort to ensure that complaints are dealt with without undue delay,

      • The Store will notify the service recipient immediately after considering the complaint whether it has been accepted or refused.

  7. We hereby inform you that the use of services provided electronically via the Internet involves risks, including: (i) the operation of malware, i.e., software that, once launched, can infect files in a self-replicating manner, usually without the user's notice; (ii) the presence and operation of worms, i.e., malicious software capable of self-replicating; (iii) the possibility of spyware, i.e., software that spies on the user's online activities and installs itself without the user's knowledge, consent, or control. The Seller endeavors to ensure that the use of the Store is safe and does not cause the above inconvenience to the Buyer.

§9

Personal data

The issues of protection of Customers’ personal data are regulated in a separate document “Privacy Policy”, available at: [ ].

§10

Final provisions

  1. These Regulations are available at the electronic address almidecor.com in an electronic version, enabling their acquisition, reproduction and recording via the IT system used by the Customer.

  2. The Seller may change the Regulations in the event of:

    1. changes in the Seller's scope of business;

    2. making technical modifications to the Store that require adapting the provisions of the Regulations to them;

    3. legal obligation to make changes, including the obligation to adapt the Regulations to the amended wording of generally applicable legal acts.

  3. Customers with an Account will be notified of any changes to the Terms and Conditions via email. Changes to the Terms and Conditions do not affect Orders placed before the effective date of the changes. If the Customer does not accept the changes to the Terms and Conditions, they are entitled to terminate the contract for the provision of electronic services (by creating an Account) by sending a statement to the Seller's registered office address or via email within 14 days of the changes coming into effect. Failure to terminate the contract shall be deemed to constitute consent to the provision of services by the Seller electronically in accordance with the new provisions of the Regulations.

  4. Any disputes arising from the implementation of the Agreement and the Regulations will be resolved by the parties in the first instance through amicable settlement. Failure to reach an agreement will result in the dispute being resolved by a court of competent jurisdiction in accordance with applicable law.

  5. In matters not regulated in these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
