Store regulations
§1
General provisions

These Regulations define the conditions for concluding contracts for the sale of goods in the online store operated in the almidecor.com domain and the procedure for filing complaints regarding goods purchased there.

The legal basis for these Regulations is in particular:

Act of 18 July 2002 on the provision of services by electronic means;
-
Act of 30 May 2014 on consumer rights;
-
Act of 23 April 1964 – Civil Code;
-
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

The terms used in these Regulations mean:
-
Shop – online shop located in the almidecor.com internet domain , within which distance sales contracts are concluded;

AlmiDecor or Seller - Fargotex Sp. z o. o. with its registered office at Al. Legionów 114C, 18-400 Łomża, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000183232, NIP (Tax Identification Number): 7181721036, REGON (National Business Registry Number): 450692080, being the owner of the Store;

Customer – an entity (including a Consumer) making purchases in the Store;
-
Consumer – a natural person making purchases in the Store for purposes not directly related to his or her business or professional activity;
-
Goods or Goods – movable items that can be purchased by the Customer in the Store;
-
Order – the procedure leading to the conclusion of the Sales Agreement using the order form available on the Store’s website;
-
Agreement – a contract for the sale of Goods concluded between the Customer and AlmiDecor,
-
Cart – an electronic form through which the Customer places an Order;
-
Registration – creation by the Customer of an individual account in the Store, facilitating the placement of Orders;
-
Data – Customer data, including personal data processed for the purpose of executing the Order;
-
Account – individual Customer account created after Registration,
-
Price – unit price of the Goods included in the description of the Goods, expressed in Polish zlotys and including VAT, excluding delivery costs;

Delivery costs – costs of delivering the Goods covered by the Customer;
-
Payment – payment for the Goods purchased by the Customer in the Store, including the Price and Delivery Costs, in the manner chosen by the Customer when placing the Order;

Regulations – these regulations for using the Store,

Information about the Goods in the Store, including descriptions and Prices, constitute an invitation to conclude an Agreement, within the meaning of Art. 71 of the Civil Code, on the principles set out in the Regulations.

The use of the Store is carried out using an IT system. For this purpose, it is necessary to have a device with access to the Internet and a web browser.

Before registering or placing an Order, the Customer is obliged to read the content of these Regulations and the document specifying the principles of processing Customers' personal data - Privacy Policy and accept them.

The content of the Store's website is the property of the Seller and is legally protected.
§2
Placing Orders
-
You can, as a Customer of the Store, place an Order in the Store using your Customer Account or without the need to register, by completing the Order form (so-called Basket).
-
Orders can be placed 24 hours a day, but will be processed on business days (Monday to Friday).

The Goods in the Store are new and free from legal defects. If the Goods have a defect, you are entitled to warranty rights regulated by the Civil Code, which we also write about below.

We may conduct periodic or one-time discount and promotional campaigns for Clients or groups of Clients selected by us. The campaigns will be conducted according to separate principles and, when required, based on appropriate regulations.

To place an Order, you select the Goods and specify the quantity of Goods, the form of Payment and delivery. The selected Goods go to your Basket, after which you can start the procedure of placing an Order.

In order to properly complete your Order and confirm all elements of the concluded Agreement, we need the following Data:

Client's name and surname,
-
delivery address,
-
telephone number,
-
email address.
-

Providing the above Data is voluntary, but necessary for the execution of the Order. In case of doubts as to the truthfulness or correctness of the Data, we will attempt to contact you in order to verify the Data.

The condition for placing an Order is acceptance of the Regulations and Privacy Policy by checking the appropriate box.

After completing the Order placement process and selecting all delivery parameters, in order to send the Order, you should click the "Order and pay" icon, which is tantamount to accepting the obligation to pay the Price and Delivery Costs for the Goods you ordered.

After sending us the Order in the manner indicated in paragraph 9 above, you will receive an e-mail confirming the conclusion of the Agreement and acceptance of the Order for fulfillment. Please contact us if you do not receive an e-mail confirming your order.

Upon receipt of the e-mail referred to in paragraph 10 above, an Agreement is concluded under which AlmiDecor is obliged to deliver the Goods selected by you and you are obliged to pay the Price and Delivery Costs.

Payments can be made by credit card, online transfer, using fast online transfer applications or when receiving the Goods (cash on delivery). If cash on delivery is not selected, we will start processing the Order after receiving payment from you. In such a case, please make the payment within 24 hours of receiving confirmation of the conclusion of the Agreement from us, because during this time we will reserve the Goods selected in the Order for you. More information on the method of payment can be found in § 4 below.

AlmiDecor may change the assortment of Goods in the Store, their Prices and Shipping Costs. This will not change the Agreement concluded before the above changes.

If the ordered Goods are unavailable in the Store and we are unable to deliver them within the specified Order processing times, we will immediately refund the paid: Price and Delivery Costs (if incurred).

AlmiDecor also allows you to place an order via email to sklep@almidecor.com or by phone through a consultant at 22 49 80 10. The provisions of these regulations apply to such orders.
§3
Account
-
The Store provides the possibility of creating an individual Customer Account, through Registration. When placing Orders using your Customer Account, you do not have to provide Data each time, and you also have the possibility of using other functionalities of the Store, indicated in point 7 below.

In order to create a Customer Account, you must Register using the electronic registration form provided on the Store’s website.

The registration form contains fields that are voluntary but necessary to create an Account and place Orders through it. You should provide the following data in particular:

name and surname,
-
email address,
-
telephone number,
-
password.
-

Please provide correct and true data so that we can properly and efficiently complete your Orders.
-
Access to the Account is secured by a password chosen by you, which can be changed using the appropriate functionality available on the Account pages.
-
The password should not be made available to third parties. This does not apply to Clients who are entrepreneurs who make the password available within the organizational structure of their company.

Having an individual Account will enable you in particular to:
-
placing Orders without the need to provide Data each time for the execution of the Order (in the event of a change of delivery address, the Customer may provide several addresses),
-
viewing the Customer's purchase history,
-
monitoring the status of placed Orders,
-

After sending the completed registration form, you will receive a message to the provided email address confirming the creation of the Account and from then on you can use it. An activation message will be sent to the provided email address. Clicking on the link in this email means acceptance of the Regulations and Privacy Policy and leads to the conclusion of an agreement for the provision of services by electronic means for an indefinite period.

Data can be edited and corrected by editing the "My Account" tab. You can also supplement your Data in the Account, in particular with the following data:

You may terminate the agreement for the provision of electronic services at any time and without giving a reason with immediate effect by deleting your Account. To do this, you should log in to your Account and click the "delete account" option.

The Seller may terminate the agreement for the provision of services by electronic means with immediate effect and delete the Account if you use the Store in a manner contrary to the provisions of generally applicable law, the provisions of the Regulations, as well as good customs or if you provide content of an illegal nature.

Deleting the Account does not affect the performance of Agreements concluded before deleting the Account.
§4
Payments

Payments can be made before the Order is fulfilled (prepayment) or upon receipt (cash on delivery), depending on the payment method you choose,

In the scope of payment in advance (before the execution of the Order), the Seller accepts the following payment methods:
-
payment by payment card (debit) or credit card via an external payment operator (Tpay) – payment for the order using Visa or MasterCard;
-
payment by electronic transfer – payment for the order by means of a direct transfer from an account in one of the selected banks: Alior Bank SA, Bank Pekao SA, PKO Bank Polski, Inteligo, mBank, ING Bank Śląski SA, Bank Millennium SA, Bank Zachodni WBK SA, Eurobank, Citibank Handlowy SA, Credit Agricole Polska SA, Getin Bank SA, T-Mobile Usługi Bankowe, Bank Pocztowy SA, Bank Ochrony Środowiska SA, Idea Bank, Cooperative Banks, Bank Gospodarki Żywnościowej SA, Neo Bank, Raiffeisen Bank Polska SA, Deutsche Bank PBC SA, Smart Bank, Plus Bank SA, Toyota Bank, Volkswagen Bank;

payment from PayPal account - payment for the order by transfer from a PayPal account or a card configured with it;

transfer to the AlmiDecor company account – payment for the order to the following company account:

Please enter your order number as the transfer title.
If payment is not made within 14 days, the order will be automatically canceled.

In the case of cash on delivery (Standard shipping within the EU only) – payment for the order is made upon delivery of the parcel by the courier.

In the event of selecting Payment in the manner referred to in paragraph 2 points a) and b) above, the Customer is automatically redirected to an external electronic payment service (Tpay or PayPal) and follows the instructions contained therein. Making a payment using an external operator requires registration in the selected payment service.

The date of payment is the date on which the amount due is credited to AlmiDecor’s bank account or the date of receipt of confirmation of accepted payment from an external payment operator.

Cash on delivery (upon receipt of the Order from the courier company) may be made by paying cash to the courier for Orders fulfilled by the courier company.

AlmiDecor automatically issues a VAT invoice for customers who provide their Tax Identification Number when placing an order.

AlmiDecor accepts the payment methods indicated above. Information about the accepted payment methods is also available on the Store's home page.

AlmiDecor does not charge any additional fees for your chosen payment method beyond the costs incurred by AlmiDecor in this respect.
All payment methods meet the highest standards of security for your data.
§5
Delivery

Goods purchased in the almidecor.com store are delivered to the address indicated in the Order.
-
Delivery of the ordered Goods is carried out within the European Union.
-
At AlmiDecor we offer the following delivery options:
-
Standard Delivery:
-
Standard Delivery includes shipping of goods to the address indicated by the Customer without the option of additional unpacking and assembly.

Standard delivery within the EU is priced individually each time
-
Standard delivery is available throughout Poland and European Union countries.
-
Standard delivery (courier shipment) within Poland is carried out in the case of payment both in advance (before the execution of the Order) and cash on delivery (upon receipt of the Order),
-
Delivery of Bulky Goods (bulky shipment) within Poland is only possible upon payment in advance (before the Order is fulfilled), payment upon receipt of the Order is not possible,
-
Delivery of Bulky Goods (courier shipment or bulky shipment) in other European Union countries is only possible if paid in advance (before the Order is fulfilled); payment upon receipt of the Order is not possible.

The ordered Goods are sent within the time specified in the Ordering process and on the store website in the Order Basket. The Goods are sent after the payment has been credited to our account or after receiving payment confirmation from our billing partner.

In the case of Goods that we currently have in stock, the delivery time of the Goods should not be longer than 4 business days from the date of shipment.

You will receive details regarding the delivery of Goods during the Order placement process in the Basket, next to the selected Goods, as well as in the "Order Summary" tab.

When receiving the shipment, after signing the bill of lading, please open the package and then check very carefully whether the ordered Goods have no mechanical damage. In the event of finding any mechanical damage caused during transport, you should refuse to accept the package and draw up a damage report with the courier. Please inform the store staff about the problem by e-mail (sklep@almidecor.com) or by phone (22 490 80 10).

IMPORTANT! In the event of failure to make full payment for the Order within 14 days from the date of placing the Order, the Seller has the right to withdraw from the Agreement. Information about withdrawal from the agreement is preceded by an email reminder to pay for the Order under penalty of cancellation of the Order.
§6
Withdrawal from the Agreement

If you conclude the Agreement as a Consumer, you have the right to withdraw from the concluded Agreement without giving any reason, under the terms indicated below.
-
The deadline for withdrawal from the Contract expires after 14 days from the day on which you came into possession of the Goods or on which a third party other than the carrier and indicated by you came into possession of the Goods.
-
To exercise the right of withdrawal, you must inform us of your decision to withdraw from the Contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail) sent to the following address: AL. Marszałka Józefa Piłsudskiego 70, 18-400 Łomża .

You may use the model withdrawal form that will be delivered to you together with the Goods, however, this is not obligatory. You may also complete and send a scan of the withdrawal form or any other unequivocal statement by e-mail to the following e-mail address: sklep@almidecor.com . If you use this option, we will immediately send you confirmation of receipt of information on withdrawal from the Agreement on a durable medium (e.g. e-mail).

In order to meet the deadline for withdrawal from the Agreement, it is sufficient for you to send information concerning the exercise of your right to withdraw from the Agreement before the deadline for withdrawal expires.

The Goods in respect of which you withdraw from the Contract must be sent to the following postal address: AL. Marszałka Józefa Piłsudskiego 70, 18-400 Łomża, immediately and in any event no later than 14 days from the date on which you informed us of your withdrawal from this Contract. The deadline is met if you send back the Goods before the expiry of the 14-day period.

In the event of withdrawal from the Agreement, AlmiDecor will refund the cost of the purchased goods and the costs of delivery to the Customer selected when placing the Order (Standard or Premium). These costs will be refunded within 14 days from the date on which we were informed of your decision to exercise the right to withdraw from the Agreement.

AlmiDecor does not bear the costs of shipping the goods from the Customer to the "Seller's" headquarters. The costs of returning the goods are borne by the "Buyer" - returns sent at the expense of the "Seller" will not be accepted.

The refund of the costs related to the withdrawal from the Agreement by the Customer will be made using the same means of payment that were used in the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees in connection with this refund. IN THE CASE OF PAYMENT BY CASH ON DELIVERY (ON DELIVERY), THE REFUND WILL BE MADE TO THE ACCOUNT NUMBER INDICATED BY THE CUSTOMER. We may withhold the refund until we receive the Goods or until we are provided with proof of their return, depending on which event occurs first.

Pursuant to Article 38, point 3 of the Consumer Rights Act, you do not have the right to withdraw from the Agreement if the Goods were manufactured in accordance with your specifications or were adapted to your individual needs (e.g. furniture modifications in accordance with your wishes),

The customer is liable for any reduction in the value of the item resulting from using the item in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.
§7
Complaints: compliance of goods with the contract / defects
We are obliged to deliver goods without defects. In the event of non-conformity of the goods with the contract, the Consumer has the rights specified in Chapter 5a of the Consumer Rights Act. Under the terms specified therein, the Consumer may request the repair or replacement of goods that are not in accordance with the contract, or submit a declaration of a reduction in the price of the goods or withdraw from the contract. We are liable for the non-conformity of the goods with the contract revealed within 2 years of its delivery, unless we have specified a longer shelf life for the given goods - in such a case, this longer period applies. In the event of non-conformity of the goods with the contract, the above provisions regarding the Consumer also apply to a natural person concluding a contract directly related to their business activity, when it results from the content of this contract that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by them, made available on the basis of the provisions on the Central Register and Information on Business Activity.

IMPORTANT! When receiving the order, please check carefully whether the Goods have not suffered any mechanical damage caused during transport. When receiving the package, after signing the bill of lading, please open the package and then check very carefully whether the ordered Goods are not damaged. In the event of finding any mechanical damage caused during transport, you should refuse to accept the package and draw up a damage report with the courier. Please inform the Customer Service Department about the problem (tel. 22 490 80 10).
§8
Special provisions related to the provision of services by AlmiDecor via electronic means

In the scope of services provided electronically by AlmiDecor, the Regulations constitute the regulations for the provision of services electronically within the meaning of the relevant provisions of law.

The Regulations may be downloaded from the almidecor.com website as a PDF file, saved on memory media and printed in any number of copies without any restrictions .

The types and scope of services provided electronically by the Store are as follows:
-
Concluding online sales agreements – in the scope of Goods sold in the Store,
-
Ability to track order status,
-
Possibility to add opinions and comments,
-
Sending the newsletter – if the Customer consents to receiving commercial information.

The terms and conditions for providing services by electronic means, and in particular the technical requirements necessary for cooperation with the IT system used by the Store, are as follows:
-
Internet connection (minimum bandwidth of no less than 1 Mbits/ 512 kbits, permanent, public address),
-
a web browser that allows you to display hypertext documents (HTML) on your computer screen, such as Firefox, Internet Explorer or similar,
-
having an email account.

Customers of the Store are prohibited from providing content of an illegal nature.
-
The complaint procedure for services provided electronically is as follows:

In the scope of performance of Sales Agreements, the conditions for filing complaints are specified in § 7 of the Regulations,
-
To the extent not related to the performance of sales agreements, service recipients have the right to submit complaints regarding services provided electronically by AlmiDecor in the manner described below,

The complaint may be sent by e-mail to the address: sklep@almidecor.com or submitted in writing to the address : Fargotex Sp. z o. o., Al. Legionów 114C, 18-400 Łomża ,

The complaint should include the name of the service recipient and an indication of the circumstances justifying its submission,
-
We will make every effort to ensure that complaints are dealt with without undue delay,
-
The Store will notify the service recipient about the acceptance or refusal to accept the complaint immediately after considering it.

We inform you that the use of services provided electronically via the Internet is associated with risks, including: (i) the operation of malware programs, i.e. software that is able to, after being launched, infect files in a self-replicating manner, usually without being noticed by the user, (ii) the presence and operation of Internet worms, i.e. malicious software capable of self-replicating, (iii) the possibility of spyware, i.e. software that spies on the user's activities on the Internet, installing itself without their knowledge, consent and control. The Seller makes every effort to ensure that the use of the Store is safe and does not cause the above inconveniences for the Buyer.

Personal data
The issues of protection of Customers’ personal data are regulated in a separate document “Privacy Policy”, available at: [ … ].
§10
Final provisions

These Regulations are available at the electronic address almidecor.com in an electronic version, enabling their acquisition, reproduction and recording using the IT system used by the Customer.

The Seller may change the Regulations in the event of:
-
changes in the Seller's scope of business;
-
making technical modifications to the Store that require adapting the provisions of the Regulations to them;
-
legal obligation to make changes, including the obligation to adapt the Regulations to the amended wording of generally applicable legal acts.

Customers with an Account will be notified of any changes to the Regulations by e-mail. Changes to the Regulations do not affect Orders placed before the date the changes come into effect. In the event of non-acceptance of changes to the Regulations, the Customer is entitled to terminate the agreement for the provision of services by electronic means (creation of an Account) by sending a statement to the Seller's registered office address or by e-mail within 14 days of the date the changes come into effect. Failure to terminate the contract shall be deemed to constitute consent to the provision by the Seller of services electronically in accordance with the new provisions of the Regulations.

Any disputes arising from the implementation of the provisions of the Agreement and the Regulations, the parties will first try to settle by agreement. In the absence of such agreement, disputes shall be subject to resolution by a common court having jurisdiction according to the provisions of law.

In matters not regulated in these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
